The Industrial Age may have not completely left America. In late
November, Joyce Kolb of Penguin Palace received a letter from Ronald
Kadden, the legal representative for England-based book company Penguin
Books Lmt. Penguin Books had found the world wide web page for Penguin
Palace comics. Penguin Books Lmt is now suing Penguin Palace for 100,000.
The reason: trademark infringement on the word Penguin.
In 1994, Penguin Books Lmt made 75,000,000 in sales. In that
year, Penguin Palace made 250.
Penguin Books and Penguin Palace cover different areas in the
publishing field. Penguin Books Lmt does a lot of educational novels,
while Penguin Palace is involved with the comic book and role playing game
mediums. The logos are completely different Penguin Palace uses a
stylish penguin head with a top hat and Penguin Books Lmt uses a full
bodied naked penguin.
Penguin Books has had their trademark on the representation of a
penguin and on the word penguin since 1952. The owner of Penguin Palace,
17 year old Joyce Kolb, wasnt even born until 1978. Penguin is a noun
that depicts a small flightless bird. Imagine if someone decided to
copyright the word human.
Stop the monopoly on penguins. Theyre birds. They waddle. Penguin
Palace is a small independent company run by minors that needs your help.
