In late November, Joyce Kolb of Penguin Palace received a letter from Ronald Kadden, the legal representative for England-based book company Penguin Books Lmt. Penguin Books had found the world wide web page for Penguin Palace comics. Penguin Books Lmt is now suing Penguin Palace for $100,000. The reason: trademark infringement on the word "Penguin." In 1994, Penguin Books Lmt made $75,000,000 in sales. In that year, Penguin Palace made $250. Penguin Books and Penguin Palace cover different areas in the publishing field. Penguin Books Lmt does a lot of educational novels, while Penguin Palace is involved with the comic book and role playing game mediums. The logos are completely different; Penguin Palace uses a stylish penguin head with a top hat and Penguin Books Lmt uses a full bodied naked penguin. Penguin Books has had their trademark on the representation of a penguin and on the word "penguin" since 1952. The owner of Penguin Palace, 17 year old Joyce Kolb, wasn't even born until 1978. "Penguin" is a noun that depicts a small flightless bird. Imagine if someone decided to copyright the word "human." Stop the monopoly on penguins. They're birds. They waddle.
